The information does not apply to the processing of personal data of employees, job applicants, or data entrusted for processing under the entrustment agreement.

SOURCE OF DATA ACQUISITION AND DATA CATEGORIES SHARED BY OTHER ENTITIES

Modus may receive contact details directly from the data subject (e.g. via electronic forms or during a conference) or through other people (e.g. from an employer, other employee or other entity with whom this person cooperates on a regular basis).
In the case of direct contact, you have full control over the scope of data made available to Modus.

LEGAL BASIS, PROCESSING PURPOSES, PROCESSING PERIOD

Personal data is processed by Modus for the purposes set out below.
For each purpose, we have provided the legal basis for processing and the criteria for determining the period of data processing for this purpose.

If a contract or order is concluded between you and Modus, the data provided by you will be processed
in order to perform such a contract or order and their settlement.
In the case of electronic forms for downloading / ordering a file (e.g. e-book, demo, report, etc.), the data provided will be processed in order to deliver the ordered file and for related contacts and possible settlements.
In the case of electronic forms that allow you to sign up for a conference, training or other event organized by Modus, the data provided will be processed in order to organize the event and for the purpose of contacting you related to this event and possible settlements.

PURPOSE: business contacts, LEGAL BASIS: art. 6 sec. 1 point f) GDPR
PROCESSING PERIOD: until the objection submitted pursuant to Art. 21 GDPR<

Contact details entered on an electronic form, provided under a contract or order, or otherwise provided, may be processed by representatives of Modus for the purpose of business contacts.
Modus representatives may contact you to present the Modus offer, invite you to a meeting or event organized by Modus or as part of other marketing activities. You may receive information from time to time regarding products, services or activities of Studio Form and other information related to the areas of Modus activities.
If you are a representative of a supplier or service provider, Modus representatives may also contact you
with you to obtain an offer, information or documents.
In this case, the processing of your data will be undertaken in order to implement the legitimate interest of the administrator, which is marketing and sale of products and services, as well as building and strengthening business relationships.

PURPOSE: newsletter, LEGAL BASIS: art. 6 sec. 1 point a) of the GDPR
PROCESSING PERIOD: until you unsubscribe from the newsletter (withdrawal of consent)

If you agree to receive the newsletter from Modus, your e-mail address will be used to send newsletters. The newsletter will be sent to you with the frequency selected by the marketing department so as to provide you with access to up-to-date information about the offer and activities of Modus as well as other information regarding the areas of Modus activities.
Please note that, regardless of the consent to the newsletter, the administrators may have a basis to process your data for the purpose of business contacts as part of the legitimate interest of the administrator (in accordance with point II).

If you apply for participation in a conference, training or other event organized by Modus, the data provided may be made available to other participants, speakers, hotels and other entities related to the organization of the event. Information about the speakers may also be made publicly available on the website, in the event application, as well as in promotional and conference materials.
In such a case, the processing of your data will be undertaken in order to implement the legitimate interest of the administrator, which is the performance of concluded contracts, the performance of obligations and promotion by organizing events.
You have the right to object to such processing of personal data in accordance with the information in the section AUTHORIZATIONS.

PURPOSE: performance of a contract or order between Modus and another entity, LEGAL BASIS:: art. 6 sec. 1 point f) GDPR
PROCESSING PERIOD: the period of performance of obligations and the period of limitation of claims resulting from the provisions or until the objection submitted pursuant to art. 21 GDPR

If you are indicated as a contact person by your employer or other entity, your data may be processed for the purpose of performing and settling the contract (or order) concluded between Modus and your employer or other entity. In this case, data processing will include ongoing contacts related to the implementation of such a contract, preparation and archiving of documentation from the performance of the contract, as well as pursuing claims or defense against claims of the other party.
In such a case, the processing of your data will be undertaken in order to implement the legitimate interest of the administrator, which is the protection of rights, performance of concluded contracts and obtaining due remuneration on this account.
You have the right to object to such processing of personal data in accordance with the information in the section AUTHORIZATIONS.

PURPOSE: cooperation with the Modus partner, LEGAL BASIS:: art. 6 sec. 1 point f) GDPR

If you are interested in a product or service distributed through the Modus network of partners, your personal data will be made available to a dedicated partner. This applies when you are a potential or current customer of Modus, such as and situations where a party to the contract or order is / will be your employer or entity with whom you cooperate.
The processing of your data will in this case be undertaken in order to implement the legitimate interest of the administrator, which is the performance of concluded contracts, business development and the development of a network of regular partners.

Contacting a representative of Modus will be treated as consent to such contacts. In the event of consent, consent is voluntary and may be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of data processing prior to the withdrawal of consent.

In the case of electronic forms - providing data is voluntary, but failure to provide data indicated as obligatory (required) results in the inability to send the form and, consequently, depending on the type of form, the inability to download the file, participation in the event or subscription to the newsletter. In the case of data collected by representatives of Modus in the field of purchasing, sales or marketing activities - providing the data is fully voluntary and the consequence of not providing it may be the inability to contact you in the future. In the case of data of persons who are a party to the contract / order concluded with Modus - providing data necessary to perform the contract and fulfill legal obligations is a condition for the conclusion and performance of the contract.

UNSUSCRIBING FROM THE NEWSLETTER

If you consent to the newsletter - consent to the newsletter is voluntary and may be withdrawn at any time. For this purpose, please follow the instructions contained in the newsletter you receive or use the contact details contained in the section "CONTACT DETAILS IN MATTERS CONCERNING PERSONAL DATA".
Withdrawal of consent does not affect the lawfulness of data processing prior to the withdrawal of consent.

DATA RECIPIENTS, TRANSFER TO THIRD COUNTRIES

Contact details are stored on Modus servers, but are remotely available to representatives of Modus.
Therefore, we would like to inform you that personal data may be transferred to a country outside the EU in which Modus operates.
